Preamble
 |
Believing it to be the natural right of those who toil they shall enjoy to the fullest extent the wealth created by their labour;
Believing that it is impossible to obtain the full reward of labour except by united efforts of the toiling workers in Education.
Realizing that organized united effort could be best made through a Central Organization of Teachers’ Associations founded upon sound principles, solely dedicated to the cause of working class, competent to meet the growing responsibilities of a Modern Teachers’ Organization and capable cable to lead the workers of the country; imparting formal and informal education.
And realizing that the existing Central Organizations such as PTOC, APGSTA, PLTA being ineffective, un-representative and un-democratic in character and have miserably failed to accomplish any thing;
This founding Convention held on 01-02-1997 attended by the Teachers’ Representatives of various Teachers’ Associations having considered the Convener’s Report and gone through the Articles of the Constitution of TCOP hereby unanimously resolves to form the “Teachers’ Consortium of Pakistan” and adopts its Constitution. Further resolves to ratify the affiliation of Teachers’ Associations in this Founding Convention and joining the TCOP as its founding Members.

Article-1 Name and Headquarter

Federation shall mean Organization of Affiliated Teachers’ Associations operating in Country and allied group promoting education. “UNIT” shall mean Teachers’ Associations and Education Societies affiliated to TCOP. “General Council” shall mean the general body of the Federation composed of the representatives of units. “Executive Board” shall mean the governing body of the Federation elected by its General Council. “Committee / Sub-Committee” shall mean a body appointed by the Executive Board / General Council of the Federation for a specific purpose. “Member of the General Council” shall mean the representatives of the units on the General Council. “Member of the Federation shall mean the unit. |

Article-3 Aims and Objectives
 |
| The aims and objects of the Federation shall be the promotion of unity, goodwill and welfare of its federating units for which purpose and end in view, it shall: |

Seek Universal recognition and enforcement of the right of trade union organization and collective bargaining.
Represent Pakistan’s Teachers in International Agencies performing functions which affect their social, economic and occupational conductions.
Furnish its units with information on the Scales, Salaries and working conditions of deferent teachers in deferent parts of the country as well as the World.
Co-ordinate, direct, assist and guide the activities of federating units in all matters directly or indirectly effecting the economic, social and political interests of the workers / teachers of Pakistan as a whole.
Endeavour to strengthen National Solidarity amongst the teachers of other countries to defend fundamental and democratic rights of teachers and other common interest. |

Endeavour to secure improved better relationship between the Govt. officials and the Teachers. |

Work for the abolition of Contract Labour in any form, |

Help and guide the Teachers in organizing themselves into Association of Federation. |

Constitution Part-III
 |
Article-4 Affiliation (Membership)
 |
| The affiliation of Federation shall be open to all the Teachers’ Associations and educational societies of Pakistan provided that: |

They subscribe to the aims and objects of the TCOP as defined in the constitution.
They ensure democratic conduct of their affairs through their Conducts and practices.
They undertake to fulfill the obligations arising from the affiliation, all affiliated organizations shall retain their full independence except where it concerns the obligations under this constitution and upon decisions of the Federation.
Application for membership shall be submitted in prescribed form accompanied by admission fee of Rs. 125/- to the Secretary General of the Federation. The Secretary General shall place the application before the Executive Board, which shall have powers to accept or reject such application. |

Article-5 Subscription
 |

A minimum subscription of Rs. 100/- annually shall be payable by each unit irrespective of number of its members.
A unit having membership of 50 or more shall pay monthly subscription @ Rs. 4/- per member latest by the 30th of April each month. However, subscription can be paid in quarterly installments. |
|

Notwithstanding Sub-Clause (a) above the Executive Board on receipt of a written request from unit may extend the period for payment of subscription.
A unit having failed to pay the subscription within the prescribed period shall be liable to have its affiliation cancelled by the Executive Board.
A defaulting unit on cancellation of affiliation may be re-affiliated on submission of reasonable explanation to the Executive Board provided due arrears are paid with a cash penalty of Rs. 25/-. |

Article-6 Administrative Structure of Dues Collection and Distribution

Each Affiliated Association (Unit) will collect Rs. 12/- from it members as monthly dues at Union Council Level.
Finance Secretary of the Union Council Executive Board of the Union will realize the monthly due Rs. 12/- from its members. |

The Federation shall raise funds by Admission fees, subscriptions, Donations and by any other means not contrary to law and the articles of the Constitution. |

Purchase of lands and buildings or any other assets for the use of Federation in furtherance of its aims and objects.
Any other purchases within the aims and objects of the Federation. |

Funds when not used shall be deposited in the Bank or otherwise invested in Government Security as may be decided by the Executive Board.
The Bank account shall be operated under the joint signatures of the Finance Secretary and Secretary General or any one of the following office bearers:

Article-7 Right of Representation

| All units shall be entitled to retain their representatives on the General Council of the TCOP, according to the following scales: |

Article-9 Officials of the Federation and their Duties and Responsibilities

| President – The President shall: |

Be responsible for the smooth running of the Federation.
Exercise his discretion if there is a tie and will have a casting vote.

The Vice President shall help the President in performance of his duties.
In the absence of the President, the Vice President shall perform the duties of the President.

The Vice President shall be responsible for Federation’s interest and organizational work in their respective areas.

shall be responsible for organizing new Association kinds of meetings / Seminars etc. under the direct supervision of Secretary General / Secretary.

| Article-10 Power and Functions of the Executive Board |
| The Executive Board shall be responsible for the executing directions and management of the Federation for which purposes it shall have the full powers and authority to: |

Interpret the clauses of the constitution and rules framed there under and enforce their observance and compliance.
Decide all questions with regard to which there are no specific provisions in the Construction, or rules framed there under and such decisions shall be fully effective unless they are revised at the next meeting of the General Council.
Make Rules subject to these Articles for the proper conduct of the business of the Federation, which shall be confirmed, modified or rescinded at the next session of the General Council.
Appoint committees / sub-committees either from amongst the units or from persons recommended by them or if considered necessary in the interest of the Federation from persons having specialized knowledge.
Delegates powers to any of its members for any specific purpose.
Select delegates, observers and other persons to attend any National or International Conferences, Educational Courses, etc. which it consider the interest of the Federation.
Appoint, suspend and / or dismiss any salaried employee of the Federation.
Suspend / expel any office Bearer or any member of the Executive Board or any unit if in its opinion, the person or the unit has been found guilty of conduct calculated to injure or bring disrespect to the federation or if any of them have acted contrary to the constitution of the Federation or the rules framed there under. Such suspension / expulsion shall be subject to review by the General Council and if confirmed effect the removal of the person or disaffiliation of the unit from the Federation as the case may be.
Depute persons from amongst its members to the General and / or Executive Committee meeting of the Federation if considered necessary.
Establish offices / sub-offices in various towns / provinces / Regions to co-ordinate the activities of the Federation for the smooth running of the units.
Receiving names of General Council Representatives from units of the Federation.
Establish, fix time, date and place for General Council Sessions.
Appoint Auditors and fix their remuneration.
Assign / Mortgage asset/s, moveable and immovable property, building/s to any financial institution / bank/s, to acquire / obtain loan/s, for carrying out cooperative or Socio-Economic Projects for the benefit of its affiliates and their membership. |

| Article-11 Executive Board Meetings |

The Executive Board shall meet at least once in four months.
The Secretary General or in his absence the Assistant Secretary General shall convene meetings of the Executive Board.
At least 10 days’ notice shall be given, but emergency meetings may be called on 3 days notice.
The notice shall specify time, date, place of the meetings and the business to be transacted.
Any other business not specified in the notice may be transacted with the permission of the Chairman.
The Secretary General shall convene the meeting of the Executive Board if he receives a written request from more than half of the members of the Executive Board. Such a meeting shall be convened within one month from the date of receipt of such request. |

| Article-12 General Council |

The General Council shall mean the General Body of the TCOP composed of the representatives of the units as per Article 7.
The General Council Session shall be convened on days to be determined by the Executive Board but shall be held at least once in every 2 years.
The Extra-ordinary session of the General Council may be convened when one-third of the units or one third of members of the Executive Board are of the opinion that the circumstances require it. |

| Article-13 Functions of the General Council |

To consider and decide appeals, if any, referred against any decision of the Executive Board.
Consider and decide any matter referred to it by the Executive Board.
Take disciplinary action against any officer of the Organization if he is found guilty of misconduct or branch of rules.
Elect the Executive Board as per Article 8 including office bearers in its Session after every 2 years.
Add, modify or rescind any of the articles of the Constitution or the rules framed there under.
Ratify or reject action taken or Resolution passed by the Executive Board. |

| Article-14 General Council Session |
| The Biennial General Council Session of the Federation shall be held by the end of December (latest) every alternate year. Notice of at least 21 days shall be given to all the members of the General Council specifying the time, date and place of the session and the business to the transacted as under: |

Adoption of the Biennial Report and duly audited statement of accounts of the Federation.
Consideration of any matter specified in the notice of the session.
Election of the office bearers and members of the Executive Board.
Consideration of any other matter brought forward with the permission of the Chair, accept changes in any articles of the Constitution or its Rules. |

| Article-15 Extra Ordinary General Council Sessions |
| The Secretary General or in his absence, the acting Secretary General may call an extra-ordinary session of the General Council of the Federation, if |

b. It is requisitioned in writing by at least two third members of the General Council of the Federation specifying the purpose of such requisition.
Notice of at least 15 days shall be given for an extra-ordinary General Council Session |

| Article-16 Requisitioned Sessions |
| If a session requisitioned under Article 15(1)(b) is not called within one month of the receipt of such requisition, the signatories of the requisition shall have power to hold the session after giving due notice to the members of the General Council. Only the matter specified in the requisition shall be transacted if there is a quorum as laid down in Article 19, but if there is no quorum, the session fails and cannot be adjourned. |

| Article-17 Permanent Committees |
The Executive Board shall appoint the following committees within 2 months from the date of the Bi-Annual General Council Session:

4. Credential Committee
Each of the Committees shall have a Chairman who shall be elected by the members of the committees respectively. The Chairman shall be the ex-officio members of the Executive Board and shall submit their reports to the Executive Board on their own motion or as and when called upon by the Executive Board to do so. The Executive Board shall have the powers to refer any issue to any of the committees and the committee concerned shall submit its report within the given time. |

Shall maintain an uptodate record of the representatives of the units on the General council.
Shall issue as many Credential Certificates to each unit as it has representatives on the General Council, one month prior to the Bi-Annual General Council Session.
Shall scrutinize the subscription and other dues position of each unit and determine the number of votes a unit is entitled to exercise and accordingly prepare a list showing the names of the unit, its representatives and the number of votes it is entitled to exercise.
Shall admit representatives / delegates of the units into the General Council Session on the presentation of Credential Certificates.
Shall receive letters of proxies from the outstation units attending the Session and examine the same.
Shall act as Reception Committee in the General Council Session. |

For Executive Board meeting the presence of at least 7 members shall form the quorum.
For the General Council Session participation of at least one third of the total number of units shall form the quorum.
If there is no quorum within thirty minutes of the scheduled time the meeting / session shall be adjourned to another date when the business shall be disposed off by the members present, irrespective of the quorum.
For any other Committee / Sub-committee meetings the quorum shall be one-third of the members of that committee / Sub-Committee. |

All decisions taken at any meeting / session shall be majority of votes of the members present. The Chairman shall have the casting vote.
Voting shall be by shown of hands except when otherwise decided.
Nothing however shall debar an outstation unit from exercising its full rights of voting by proxy. The proxy in such a case shall mean at least one representative of the outstation unit being present in person with a letter of authorization from the Secretary.
Only such units shall exercise full number of votes through their representatives who have fully paid the dues of the Federation. The defaulting units shall have only one vote which can be exercised through the authority of the unit concerned irrespective of the number of its representatives on the General Council. |

| Article-20 Vote of No Confidence |
| If in the opinion of any member of the Executive Board / Unit an office bearer of the Federation / Committee / Sub-Committee has acted in a manner prejudicial to the interests of the Federation and / or its units or has betrayed the confidence of the majority of the units by his / her act of negligence or willful destruction of aims and objects or has lost his / its representative character, the units may requisition an extra-ordinary General Council Session as per Article 15(i)(b) to move a vote of no confidence specifying the reasons. Having given a fair chance to the office-bearer / committee / sub-committee to defend himself / itself, if the vote of no confidence is carried the person concerned shall be removed from his office and the Committee / Sub-Committee shall be deemed to have been dissolved. |

| Article-21 Quorum |
| The following subjects shall be reserved to be exclusively dealt with by the Federation. |

Making and finalizing all policy decision in respect of the subject and matters of both National and International importance and directly or indirectly affecting the Teachers / workers of Pakistan as a whole.
Selection of Teachers’ representatives of Pakistan to all National and International Organizations, Conferences, Councils and Committees.
National co-operation and affiliation
Ordering and withdrawing of any National Strike or stoppage of work in any form.
Any other matter or matters voluntarily referred to the Federation by the units for decisions and disposal. |

| Article-22 Obligation of Units |
| Every unit shall: |

Endeavour to further the aims and objects of the Federation.
Making payment of subscription and / or special levies.
Extend all possible help to other units
Supply and information asked by the Secretariat of the Federation and also furnish copy of the Annual Return at the time of submission to the government or after its approval in the General Body Meeting whichever is earlier.
Admit to their Executive / Managing / General Body meetings any person deputed by the Federation.
Give due and sympathetic consideration to the recommendation made by the Federation.
Carry out instructions and / or directions issued by the Federation and implement its resolutions and / or decisions. |

| Article-23 Benefits |
| The units shall be eligible for and entitled to all the benefits as are assured by these articles. |
